Terms of service
1. Who we are and who these terms are for
Pixfact (“the app”, “we”) is operated by Andrei Velent, a sole trader registered in the Polish business register (CEIDG), ul. Straganiarska 20/22 lok. 35, 80-837 Gdańsk, Poland, NIP 5223258005, REGON 525284838. Contact: support@pixfact.com.
These terms apply between us and the business that installs the app in its Shopify store (“you”). By installing or using the app you accept them. The app is meant for businesses, not for consumers. How we handle data is described in our privacy policy.
2. What the app does
The app turns a product from your Shopify catalogue into ad images for Facebook and Instagram: your product photo is cut out and placed in a background scene generated by AI, and an ad text is written from your product data, in square, portrait and story formats. One creative uses one credit.
3. AI-generated content
Backgrounds and ad texts are created with AI. We check the text against your product data (numbers, claims, language), but the checks reduce mistakes and cannot rule them out. The product photo itself is not redrawn, yet cut-out edges and scenes can still look wrong. Review every creative before you publish it.
Every downloaded image carries machine-readable metadata (IPTC digital source type “composite with trained algorithmic media”) saying that it combines a real photo with AI-generated content, as the EU AI Act requires. Where an image could be taken for a real photograph, you as the publisher are responsible for labelling it visibly as AI-generated where the law requires it; advertising platforms such as Meta may also add their own “AI info” label.
4. Your responsibilities
- You have the rights to the product photos, product data and logo you use in the app.
- You are responsible for the ads you publish: their content, the prices and discounts shown, and their compliance with the law that applies to you (including consumer and advertising law, such as rules on showing a previous price next to a reduced one) and with the advertising policies of Meta and other platforms. The app shows prices and discounts exactly as they are set in your product data.
- You do not use the app to mislead customers, to infringe anyone’s rights, or to overload or attack the service (for example with scripts or many stores created to collect free credits).
5. Credits, plans and billing
- Every store gets 10 free credits once; they do not expire. Plans add credits for each 30-day billing period; unused plan credits expire when the period renews.
- Credit packs (50 creatives for $10) are one-time charges, available with or without a plan. Pack credits never expire and are used after the plan's credits.
- All charges are billed by Shopify on your Shopify invoice. Prices are listed in the app and on our App Store listing.
- An upgrade takes effect immediately and Shopify prorates the difference; for the current period you keep the credits you have and get the difference between the plans' credits. A downgrade takes effect at the start of the next billing period; until then you keep your current plan and its credits. “Cancel plan” in the app, or uninstalling, stops future charges. The current period is not refunded, so after cancelling its plan credits stay until it ends. Choosing the same or a cheaper plan again before then resumes from that date, with nothing charged until then; a more expensive plan starts at once.
- On development and test stores, plans run with test charges and give a limited number of credits for trying the app.
- Editing the text or switching the layout of a finished creative is free.
- Creatives are kept for 180 days after you last open, download or edit them, then deleted; the app shows the date and warns 14 days before. You can delete a creative yourself at any time; deleting does not return its credit. Keep the files you need: download them.
- If a creative is unusable, report it with the “Report a defect” button within 7 days: the credit is returned, up to 5 times in 30 days. A creative that fails to generate returns its credit automatically.
- Payments for past billing periods are not refunded, except where the law requires it or we decide otherwise.
6. Fair use and availability
To keep the service reliable and affordable:
- without a paid plan (free credits, test plans, development stores), a store can create up to 50 creatives in 24 hours; with a paid plan, the only limit is the plan’s credits;
- after several failed attempts within an hour, creating pauses for that store for up to an hour;
- when the load or the cost of the AI services we use is unusually high, we may pause creating for a few hours: creatives made with free credits, test plans or on development stores are paused first, paid plans last.
Your credits are not lost in these cases; the app tells you when you can continue. We aim to keep the app available but do not guarantee uninterrupted operation, and we may change, improve or discontinue features; we will give reasonable notice before discontinuing the app.
7. Your content
You keep all rights to your product data, photos and logo, and to the creatives made for you, as far as the law allows rights in AI-generated material. You allow us to process this content only to provide the app, as described in the privacy policy. We may use anonymous, aggregated statistics about how the app is used.
8. Liability
The app is provided “as is”. To the extent the law allows, we are not liable for indirect or consequential damage, lost profits, advertising spend, or ads rejected by an advertising platform, and our total liability for any claims is limited to the amount you paid for the app in the 12 months before the claim. Nothing in these terms limits liability for damage caused intentionally or where the law does not allow such a limitation.
9. Suspension and termination
You can stop using the app at any time by uninstalling it. We may suspend or end access for a store that breaches these terms, in particular section 4. After you uninstall, your data is deleted as described in the privacy policy.
10. Law and disputes
These terms are governed by Polish law. Disputes will be settled by the courts competent for Gdańsk, Poland, unless mandatory law provides otherwise.
11. Changes
We may update these terms, for example when the app or the law changes. We will show the date at the top and, for material changes, tell you in the app before they apply. Continuing to use the app after that means you accept them.
